4. reporting procedures for content that violates industrial property and copyright rights and other illegal content.
Please be reminded that under clause 1. E. 1. of the general contract conditions, by requesting registration with EGOMNIA, you commit to:
- using all services provided by EGOMNIA in full compliance with all applicable legal provisions, including laws and acts having the force of law, regulations, customs, and practices, and in any case with conduct oriented towards the principles of fairness and transparency according to professional diligence standards;
- not publishing and/or uploading illegal, defamatory, obscene, or contrary to public decency content on EGOMNIA, or constituting SPAM or "chain letters," or harmful or dangerous content (such as viruses, worms, codes, files, or programs capable of interrupting or damaging the functionality of other software or hardware of EGOMNIA or EGOMNIA users);
- not uploading confidential and/or secret and/or proprietary information that you do not have the right to disclose or make available in accordance with applicable law and/or contractual relationships. This prohibition includes, by way of example: business information; trademarks, patents, industrial property in general; content protected by copyright;
We also remind you that, under the indemnity clause (Clause 1. F. 8) of the general contract conditions, you agree to indemnify and/or compensate EGOMNIA for any form of liability that may arise against it under applicable law or that of your country or a third country, for your use of the services, or as a result of uploading data or content by you, for the inaccuracy/falsity/lack of veracity of the information provided, or due to any of your conduct, in violation of this contract and/or in breach of laws, equivalent acts, regulations, authoritative orders.
Given that on EGOMNIA, registered users can, without any filter or prior control possibility from us, enter their data and publish content, EGOMNIA is not obliged to carry out any checks on the content and data uploaded by users (with the related exclusion of liability clause, as per section F of this contract); however, EGOMNIA has adopted, in line with best practices, mechanisms for reporting content that violates industrial and copyright rights and illegal content, that is contrary to this contract and/or applicable law.
These procedures are aimed at allowing EGOMNIA to autonomously remove the aforementioned content, when appropriately reported.
Therefore, if you notice content in violation of industrial or copyright rights or other illegal content, please inform us, according to the methods set out in the general contract conditions (clause 1. H), under your responsibility and with the corresponding exemption of liability for EGOMNIA and the operation of the indemnity clause (1. F. 8), in the event that EGOMNIA incurs liability as a result of your false declaration.
